Some people see painting on walls, fences and on public places and buildings as a form of art, others don’t. Whatever your point of view, you should know the law about doing these things and what can happen if you are caught.

  • It is against the law to put up placards or posters or use paint, chalk or anything else to mark premises in a way that is visible in the street without getting the consent of the owner or occupier of the place. You can be fined if you do.

Spray Paint Graffiti

  • The penalties are much more severe for people caught using spray paint to tag or mark property. If you are caught using spray paint, you can be fined $220 and/or be ordered to perform some community service. If you have been caught and convicted for doing this many times, you can be sentenced to go to prison for up to 6 months.
  • Even just having spray paint with you can get you into trouble, if you were going to use it on someone’s property without consent. You can be fined up to $1,100 or ordered to perform community service.
